This privacy policy governs the manner in which Dynamic AI Inc. (“Company”) collects, uses, maintains and discloses information collected from users (sometimes referred to as “users” or “you”) of the Dynamic-ai.com site (the “Site”). This privacy policy applies to the services offered by Dynamic-ai (the “Services”) and supplements and incorporates our Terms of Use.

This page informs you of our policies regarding the collection, use, and disclosure of personally identifiable information when you visit our site. We will not use or share your information with anyone except as described in this Privacy Policy.

  • A Note About Children. We do not knowingly collect personally identifiable information from minors, including children under 13. If you are a parent or guardian and you learn that your child has provided us with personal information, please contact us. If we become aware that we have collected personal information or identifiable information from a minor under the age of consent without verification of parental consent, we will take steps to remove that information from our servers.

  • A Note About Users Outside of the United States. Your personally identifiable information may be processed in the country in which it was collected and in other countries, including the United States, where laws regarding processing of personally identifiable information may be less stringent than the laws in your home country.

I.Collection and use of personal information and other information.

By submitting personal information through our Site, you agree to the terms of this Privacy Policy and you expressly consent to the processing of such information in accordance with our Privacy Policy.

There are basically three categories of information that we collect:

  • Information you or your users give us.

  • Information obtained from any use of our Service.

  • Information obtained from third parties.

Here’s a little more detail on each of these categories.

A. Information You or Your Users Give Us.

If you contact us through our website or by email, we will collect your name, email address, and any other metadata or content included in your message. If you post any messages on our Site, the information contained in your posting will be stored on our service provider’s servers.

In addition to this information, we may also collect from time to time the following types of information:

By Cookies. A cookie is a small text file that is stored on a user’s computer for record-keeping purposes such as site visitation. We use cookies on this Site. We do not link the information we store in cookies to any personally identifiable information you submit while on our Site. If you choose to disable cookies, some areas of our Site may not work properly. We may use cookies for the following reasons and purposes:

  • To provide the service you have asked for. Some cookies are essential so you can navigate through the site and use its features. Without these cookies, we would not be able to provide the services you’ve requested. For example, some cookies allow us to identify subscribers and ensure they can access the subscription only pages. If a subscriber opts to disable these cookies, the user will not be able to access all of the content that a subscription entitles them to. These cookies don't gather information about you that could be used for marketing or remembering where you've been on the internet. Essential cookies keep you logged in during your visit.

By Server Logs. We may automatically store information that your computer or mobile device provides to us in connection with your use of the Service, such as your platform, type of computer or mobile device, unique device identifier, IP Address, MAC address, your physical location (including geolocation, beacon based location, and GPS location). In some cases, you may disable our use of certain location data through your device or browser settings. We may also store usage data such as the date and time the application on your device accesses our servers, and what information and files have been downloaded to the application based on your device number.

Analytics. When you visit our site, we may use third party analytics software to automatically track and collect the following categories of information through such software: (1) your Internet Protocol (IP) address and domain server address; (2) the date and time of your visit our site; (3) the type of system and browsers you used to access the site; (4) the pages that you accessed during your use of the site; and (5) other non-personally identifiable information (collectively, “Traffic Data”). Traffic Data is stored as semi-anonymous information that does not identify or track your personal identity, unless you consent to such data collection. We use Traffic Data to evaluate and improve the content of the site and to make the site more useful to visitors. We also use such information for testing and debugging purposes.

II. Uses Of Information Collected.

We may collect and use information for the following reasons:

  • To improve customer service. Information you provide helps us respond to your customer service requests and support needs more.

  • To personalize your user experience. We may use information in the aggregate to understand how our users as a group use the Service.

  • To improve the Service. We may use feedback you provide, and information we gather to improve our products and services and to send users information they agreed to receive about topics we think will be of interest to them.

  • To send you email communications we think will be of interest to you.

Aggregate Information (non-personally identifiable). At the present time, we do not share aggregated demographic and usage information about our users with any of our business partners, but we reserve the right to share aggregated anonymized (non-personally identifiable) data with our business partners. This information does not identify individual users.

Disclosure to Third Party Service Providers. We may share your personally identifiable services with our third party service providers to provide you with access to the Site and Services. Except as otherwise stated in this Privacy Policy, these third party service providers are required not to use your personally identifiable information other than to provide you the Services. You expressly consent to the sharing of your personally identifiable information with our service providers but only for the sole purpose of providing services to you.

No Third Party Marketing. We do not share your personally identifiable information with third parties for promotional purposes unless you have opted-in to such disclosure. If you have opted-in to have your personally identifiable information shared, to opt-out from receiving further communications from any third party that is not our agent or service provider, please contact that marketing partner/affiliate directly. We will only contact you with promotional, product usage, and customer service emails if you opt-in by providing us with your email address. When you receive such emails from us, you may indicate a preference to stop receiving further emails from us and you will have the opportunity to “unsubscribe” by following the opt-out instructions provided in the e-mail you receive. Despite your indicated email preferences, it may be legally necessary to send you updates to our Terms of Service or Privacy Policy.

Links to Other Sites. If you click on a link to a third-party site, you will leave the site you are visiting and go to the site you selected. Because we cannot control the activities of third parties, we cannot accept responsibility for any use of your information by such third parties, and we cannot guarantee that they will adhere to the same privacy practices as us. We encourage you to review the Privacy Policies of any other service provider from whom you request services.

Social Media (Features) and Widgets. Our Web site may include social media features, such as the Facebook Like button and Widgets, such as the Share this button or interactive mini-programs that run on our site. These Features may collect your IP address, which page you are visiting on our site, and may set a cookie to enable the Feature to function properly. Social Media Features and Widgets are either hosted by a third party or hosted directly on our Site. Your interactions with these Features are governed by the privacy policy of the company providing it.

III. How we protect your information

We adopt generally accepted data collection, storage and processing practices and security measures to protect against unauthorized access, alteration, disclosure or destruction of your personal information, username, password, transaction information and data gained from the Service and stored on our systems. You understand and agree that no system can guarantee unauthorized intrusion or hacking.

We will retain your Personal Information for as long as needed to provide the applicable Service you use, unless a longer retention period is required or permitted by law.  We will retain and use information as necessary to comply with our legal obligations, resolve disputes, and enforce our rights. We will cease to retain your personal data, or remove the means by which the data can be associated with you, as soon as it is reasonable to assume that such retention no longer serves the purpose for which the personal data was collected, and is no longer necessary for legal or business purposes.

Your California Privacy Rights

We will not share any personal data with third-parties for their direct marketing purposes to the extent prohibited by California law. If our practices change, we will do so in accordance with applicable laws and will notify you in advance. California law requires that operators of online services disclose how they respond to a Do Not Track signal. Some browsers have incorporated “Do Not Track” features. Most of these features, when turned on, send a signal or preference to the online service that a user visits, indicating that the user does not wish to be tracked. We do not currently respond to Do Not Track signal.

We do not sell, trade, or rent users’ personal identification information to third parties. We do not place advertising on the Service and we do not sell your user personal information to any third party. We may use, and we may also share non-individual, aggregated information and data with our business partners and with business users solely for the purpose of better understanding the needs, interests, and usage of our users.

We may use our own capabilities or those of third party service providers to help us operate our business and the Service or administer activities on our behalf. We intend to restrict the use of your information to the extent reasonably necessary to allow us, and our partners, to communicate with you, for you to utilize the Service and for the electronic sharing of communication information between the Service and you and your devices.

EU Users’ Rights

This section of our Privacy Policy applies to the users of our platform in the EU. We would like to inform you about your EU General Data Protection Regulation (“GDPR”) rights and how we safeguard them.

  1. Your GDPR rights to be informed, to access, rectify, erase or restrict the processing of your personal information. You have the right to receive free information about what personal data we have obtained about you, where it is stored, for how long, for what purposes it is used, to whom it was disclosed. You have the right to require that we, without undue delay, rectify of inaccurate personal data concerning you. That means you can request we change your personal data in our records, or have your incomplete personal data completed. You have the “right to be forgotten,” i.e. to have us delete your personal information, without undue delay, if the data is no longer necessary in relation to the purposes for which it was collected. However, GDPR gives us the right to refuse erasure if we can demonstrate compelling legitimate grounds for keeping your information.

  2. GDPR gives you the right to restrict processing if any of the following applies:

    1. If you contest the accuracy of your personal data, we will restrict processing it for a period enabling us to verify its accuracy.

    2. The processing is unlawful and you oppose its erasure and request instead the restriction of its use.

    3. We no longer need your personal data for the purposes of the processing, but you require us to restrict processing for the establishment, exercise or defense of legal claims.
      iv. You have objected to processing pursuant to Article 21(1) of the GDPR pending the verification whether our legitimate grounds override yours.

  3. Right to data portability. Upon request, we will provide you your personal data in our possession, in a structured, commonly used and machine-readable format. You have the right to transmit that data to another controller if doing so does not adversely affect the rights and freedoms of others.

  4. Right to object. You can object, on grounds relating your particular situation, at any time, to the processing of your personal information, if based on point (e) or (f) of Article 6(1) of the GDPR. We will then have to stop processing, unless we can demonstrate compelling legitimate grounds for the processing. If you object to the processing for direct marketing purposes, we will have to stop processing for these purposes.

  5. Right to withdraw consent. GDPR grants you the right to withdraw your earlier given consent, if any, to the processing of your personal data at any time.

  6. Rights related to automated decision making. As a responsible business, we do not rely on any automated decision making, such as profiling.

IV. Changes to Our Policy.

Where we make minor changes to our Privacy Policy, we will update our Privacy Policy with a new effective date stated at the beginning of it. Where we make major changes to our Privacy Policy or intend to use your information for a new purpose or a different purpose than the purposes for which we originally collected it, we will notify you by email (where possible) or by posting a notice on our website. We will provide you with the information about the change in question and the purpose and any other relevant information before we use your information for that new purpose.

By accessing the Service, you understand and agree that you accept the terms of this Privacy Policy. Your continued use of the Service following the posting of changes to this Privacy Policy will be deemed your acceptance of those changes.

V. Communications and Other Matters.

We may send you periodic announcements including email newsletters. You may opt out of these announcements by contacting support@dynamic-ai.com or by clicking the opt-out link at the bottom of these emails. If you opt out of these marketing emails, you may still receive system notices and other information that is specifically related to your account.

If you provide your information to us, use the site, or subscribe to any of our services, you will have created a commercial relationship with us. In having done so, you understand that even unsolicited commercial email sent from us or our affiliates is not SPAM as that term is defined under the law.
